This week, the US Justice Department sued SpaceX over its employment procedures, alleging that Elon Musk’s rocket business discriminates against refugees and those seeking asylum.
According to Assistant Attorney General Kristen Clarke’s inquiry, “SpaceX effectively banned the hiring of refugees without considering their qualifications and failed to treat them equitably when considering or hiring them because of the status of their citizenship.”
“Our investigation additionally discovered that SpaceX recruiters as well as high-level officials did things to actively discourage asylum seekers and refugees from applying for jobs at the company,” Clarke said in a statement.
According to the Justice Department, SpaceX prevented refugees and others seeking asylum from applying for positions at the business between September 2018 and May 2022 based on their citizenship status.
The department stated that “SpaceX was wrong when it said that federal rules called ‘export control laws’ meant that SpaceX was only permitted to hire US citizens and legal permanent residents, who are sometimes called ‘green card holders.'”
It stated that “Export control laws do not limit hiring in this way.”
The Justice Department claimed it would ask for back pay on behalf of asylum seekers and refugees who tried to work at SpaceX but were turned away or not hired because of claimed discrimination. It would also ask the court to fine the company.
“Asylees and refugees have been through a lot in their lives, and being treated unfairly at work because of their citizenship status shouldn’t be one of them,” Clarke said.
“Through this legal action, we intend to hold SpaceX responsible for its unlawful employment practices and demand relief that enables asylees and refugees to compete fairly for job openings and offer their talents to SpaceX’s workforce.”
