Magazine Ban News – Judge Finalizes Decision

Judge Gary Bashor of Cowlitz County Superior Court determined on Monday that Washington State’s restriction on “large capacity” magazines was unconstitutional under both the state and federal constitutions.

According to the Associated Press, Bashor made his conclusion after considering the restriction in light of the Bruen (2022) ruling from the US Supreme Court.

Less than a month after the Bruen judgment was rendered on July 14, 2022, Breitbart News noted that the ruling did not seem promising for 21st-century gun control measures since it calls for them to be assessed by a quest for historicity in American history.

The Washington Times cited the majority ruling in Bruen by Justice Clarence Thomas, who stressed the significance of the ruling, which expanded on McDonald v. Chicago (2010) and District of Columbia v. Heller (2008).

Thomas stated, “The standard that courts have to follow is if the founding fathers who wrote and approved the Second Amendment would have thought that a prohibition on weapons was reasonable. If not, the Constitution will supersede the legislation.

According to The Seattle Times, Bashor said, “The state must offer some history of regulation in keeping with the criteria of Bruen. The state has failed to do so,” in reference to Bruen in his ruling.

On Monday, he ordered an urgent injunction to prevent the execution of the rule prohibiting the publication of “large capacity” magazines.

But state attorney general of Washington Bob Ferguson swiftly challenged Bashor’s ruling to the state supreme court, and the state issued an emergency stay that allowed the ban to remain in effect while the appeal was pending.

  3. I feel I know why Biden wants to ban all firearm ownership by Americans. He wants to do away with the Second Amendment. One reason that amendment was written was so the people of this country could defend themself from a totalitarian government. One like we now face. Then, It was also written to help protect the First Amendment. As it now stands, illegal aliens can do as they please. Thanks to Biden and his Communists posing as Democrats, they, and some black people, by no means all, obviously feel they’re above the law. Many, even illegals have tried to join society and do the right thing. I feel a little slack should be given to them.

  4. How is it that the term” shall not be infringed” is so misunderstood? It is a declarative statement that makes the intention of the founders crystal clear. We need to return to the clear constitutional /common law, and jetson the maritime law.

  5. This gets interesting. The injunction was imposed because the magazine ban violated both the State Constitution [Article 1 Section 24] and US Constitution [Amendment 2]. A State Supreme Court Commissioner took 88 minutes to supposedly review a 55 page ruling which declares the ban void and decided to stay the decision.
    This was an employee of the Supreme Court who had a history working with the current Anti-Gun State AG.
    Will this go directly from State Supreme Court to US Supreme Court or will this go thru the federal court system to reach the notorious Ninth Circuit?
