A federal court ruled that New York’s “Hateful Conduct Legislation,” which attempts to control “hate speech,” on social media sites, violates the First Amendment, which forbids the federal government from controlling the speech of its citizens, and granted an injunction prohibiting the execution of the law.
In a decision handed down this week, US District Judge Andrew L. Carter Jr. of NY backed a blogger named Eugene Volokh and the video site Rumble in their opposition to Governor Kathy Hochul’s “Hateful Conduct Law” which according to Judge Carter Jr., “doesn’t articulate a compelling federal interest or ensure that the law is narrowly tailored towards that goal. It simultaneously compels social media sites to break the boundaries of constitutionally guarded speech.”
Judge Carter claimed that the rule goes against America’s “commitment to free expression, even if such speech is abhorrent.”
“It is obvious that the legislation aims to control speech. Users of social media platforms produce and curate speeches on these platforms through posting, writing, and otherwise creating content. Although the legislation appears to be directed at social media platforms, it really has a significant impact on users’ freedom of expression since it establishes a procedure and method for individuals to report the protected speech of other users.”
The “Hateful Conduct Law” in New York and the “Hate Speech Reporting Act” in California both require social media companies to submit reports on their extremism, hate speech, and disinformation policies to the state attorney general twice a year. Gavin Newsom, the governor of California, signed the legislation into law last year.

Politicians need to hold other politicians accountable. We held Nazis accountable for the atteocities yet we don’t hold democrats accountable to face the supreme court for the attrocities committed to this country. Outbursts like AOC, Tilaib, Pressley, Bush, and others should be held in contempt of court.
