As the ATF’s enhanced background check regulation, another executive gun control measure, was about to go into effect, President Joe Biden brags.
Breitbart News revealed on August 31, 2023, that the ATF has proposed a regulation that would virtually shift gun sales toward background checks for all purchases. Congress has continuously opposed passing gun control legislation for decades.
Gun Owners of America forewarned that Biden was working behind the scenes to utilize executive action to get universal background checks, which led to the introduction of the rule. Gabby Giffords’ gun control group, Giffords, was likewise excited with the announcement, having expected and applauded the decision.
A press statement announcing the proposed regulation included a quotation from Attorney General Merrick Garland, which read as follows:
“To minimize gun violence, Congress approved the bipartisan Safer Communities Act, which increases the number of background checks that prevent criminals from obtaining firearms. The purpose of this proposed regulation is to carry out the directive from Congress to broaden the scope of who has to apply for a license and undergo a background check before selling weapons.”
“This new proposed rule would define the circumstances in which a person is ‘involved in the business’ of dealing in weapons,” according to ATF director Steve Dettelbach. As a result, they would need to get a license and abide by the restrictions Congress has set for firearms dealers.
On April 11, 2024, Biden boasted to ABC News that the law would prevent domestic abusers and convicts from obtaining weapons. And my administration will keep doing all within our power to preserve lives. Congress must complete the task at hand and enact laws requiring background checks for all people.
Similar to how the ATF has redefined bump stocks as machine guns, equated unfinished handgun frames with firearms, and reclassified pistols with stabilizer braces as short barrel rifles, the agency has changed its definitions and language regarding who must submit to background checks for gun sales and transfers.

Yeah, there are the dealer forms, but how – unless they ransack each and every American’s home – are they going to prove that the original buyer didn’t sell their purchase long ago?
