The court document details that the firearm in question, along with its pouch, was initially sealed as evidence. However, upon examination in 2023, FBI investigators noticed a white powdery substance on the pouch, which they suspected to be cocaine. This suspicion was confirmed by an FBI chemist who analyzed the residue and identified it as cocaine. This evidence aligns with messages from Hunter Biden’s Apple iCloud account, which show him purchasing and using drugs around the same time he acquired the gun.
Hunter Biden has publicly struggled with drug addiction, a battle chronicled in his 2021 memoir, “Beautiful Things.” In the memoir, he discusses his addiction to crack cocaine and its impact on his life. However, prosecutors have used excerpts from his memoir and other evidence, such as photos and messages, to argue that his drug use was ongoing during the time he illegally possessed the firearm in 2018.
This revelation comes amidst Hunter Biden’s indictment in California on federal tax charges, where he is accused of failing to pay over $1 million in taxes. Selections from his memoir have also been used in this case to illustrate his extravagant lifestyle during the period of alleged tax evasion.
The DOJ’s motion strongly refutes Hunter Biden’s assertion that the prosecution is politically motivated, emphasizing that there is no evidence to support such a claim. It points out the irony in suggesting that the Executive Branch, led by his father, President Joe Biden, would authorize such prosecution for political purposes.
Hunter Biden’s legal team had previously argued for the dismissal of the gun charges, citing selective prosecution and a pretrial diversion agreement from a failed guilty plea agreement with federal prosecutors. However, the DOJ contends that this agreement is not legally binding, as it lacked the necessary signatures and never took effect.

An ordinary citizen would have been tried and found guilty and put in jail a long time ago.
