This week, Republicans in the House filed a lawsuit against two DOJ officers, alleging that they disregarded subpoenas by not showing up in person for depositions pertaining to Hunter Biden’s prosecution.
In its complaint, the Judiciary Committee asked the court in D.C. to compel the two DOJ Tax Division officers to accept and obey the subpoenas and come to the committee for interviews.
The prosecution team, including trial attorney Jack Morgan and senior litigation counsel Mark Daly, met at the Department of Justice headquarters in June 2022 to discuss potential prosecution strategies for Joe Biden. In a statement to Congress, IRS whistleblower and criminal investigator Gary Shapley said that the Tax Division was opposed to prosecuting Biden during the aforementioned discussion.
The committee has requested testimony from Morgan and Daly, and the Department of Justice has declined to produce their depositions, leading to a protracted back and forth between the two parties that has lasted many months.
The DOJ has raised concerns about the pair’s testimony for several reasons, including the fact that federal policy prohibits line-level employees from testifying, particularly in continuing matters such as the Biden case. The Department of Justice (DOJ) issued nine tax charges on the first son last year, and he is now fighting them in court. Permitting officials to discuss the case outside of court might jeopardize it, according to the DOJ.
For its part, the DOJ has referenced a rule from the Trump administration that specifies DOJ attorneys can show up to depositions if they suspect confidential information is being discussed. The House Judiciary Committee disapproves of such thinking.
“The necessity to comply with the subpoenas is different from any duty to provide purportedly sensitive data,” the committee’s attorney said in court filings.
The attorneys often referenced the House’s impeachment investigation as the basis for their case, noting that the study sought to determine if the department showed favoritism to Hunter Biden during its lengthy, multi-year examination. Their client’s legal team brought up the fact that the House is simultaneously investigating allegations that Joe Biden, the president, pushed the Department of Justice to be soft on his son. Morgan and Daly’s supervisor are among the senior DOJ officials who have denied in committee questions that politics had any influence in the decision-making process regarding the Hunter Biden case. However, House investigators believe that Morgan and Daly could have some insight into this matter.
There is an immediate need for Morgan’s and Daly’s testimony, according to the House counsel’s letter. “To this day, they continue to obstruct and drag out the Committee’s investigation by ignoring its subpoenas, and this is happening just as the Committee is attempting to conclude its fact-finding.”
Despite the Department of Justice filing nine tax charges against Hunter Biden in December for the tax years 2016 through 2019, Republicans have persisted in expressing skepticism about the accusations.
The committee counsel’s complaint asked the judge and court to issue a preliminary injunction requiring Morgan and Daly to appear over the Hunter Biden case’s 2014 and 2015 tax years, which have now passed, due to the statutes of limitations.
The committee’s legal counsel also ordered the witnesses to explain “why they allegedly revised their opinions regarding whether legal charges should be made for those years” and “whether they were under any pressure to argue” against charging Hunter Biden.
