Obama's Own FBI Investigated Ilhan Omar's Brother Marriage — Then He Called Her 'Law-Abiding'

In the summer of 2016, while Barack Obama was still president, the FBI and Department of Homeland Security opened a joint investigation into whether Representative Ilhan Omar's 2009 legal marriage to Ahmed Nur Said Elmi was fraudulent — and whether Elmi was, in fact, her brother.

That's Obama's FBI. Obama's DHS. His appointees, his agencies, his chain of command.

Fast forward to October 2026, and Obama is on camera accusing the Trump administration of bringing "the full weight of the federal government" down on a "law-abiding elected official." The investigation he's denouncing as political persecution started under his own roof.

According to sources, several current and former law-enforcement officials confirmed the 2016 probe found evidence supporting the sham-marriage theory. Prosecutors at the time declined to bring charges — not because the evidence was weak, but because they believed the five-year statute of limitations had expired. The marriage took place in 2009. By the time investigators got serious, the clock had run out.

Omar legally divorced Elmi in 2017. She legally married Ahmed Hirsi — the man she'd been in an Islamic marriage with before, during, and after the Elmi union — in 2018. The timeline alone raises questions that no press conference has ever answered.

Then things got quieter. In 2021, Biden-appointed U.S. Attorney Andrew Luger shut the probe down entirely. No charges. No public explanation. Case closed, until it wasn't.

The current investigation picked up where the Obama-era probe left off, and it hasn't been subtle. On October 12, federal agents executed a court-authorized search of Omar's Washington, D.C. residence. They seized her phone, her passport, and electronic devices. More than a dozen grand jury subpoenas have gone out — including to family members.

Omar's response has been consistent: Elmi is not her brother, the investigation is "a political attack," and "neither she nor her father committed immigration fraud." She's maintained this position for years. The FBI under two separate administrations apparently found it worth investigating anyway.

Obama's framing depends on the audience not knowing the timeline. If Trump's DOJ is politically targeting Omar, what was Obama's FBI doing in 2016? Running the same investigation for fun? The probe wasn't opened by MAGA appointees or Trump loyalists. It was opened by career agents under an administration that would later defend Omar publicly.

The statute of limitations didn't clear Omar — it protected her. Prosecutors had evidence and ran out of time. That's not exoneration. That's a technicality. And the Biden DOJ's decision to shut the case down in 2021 looks less like a judgment on the merits and more like a political favor that couldn't survive scrutiny once a new administration reopened the files.

Omar has called this a political attack. Obama has called her law-abiding. The FBI under Obama opened the case. The FBI under Biden closed it. The FBI under Trump reopened it and got a search warrant.

Two out of three administrations thought it was worth investigating. The one that shut it down appointed the prosecutor who killed it.
