According to rumors, the Department Of justice will appeal the appointment of a special master to the Eleventh Circuit.
A special master, a mediator chosen by the court, would examine the papers taken by the FBI from Trump’s home on August 8.
It is puzzling that the former president did not file a move before Reinhart to request the special master on that basis. One also has to wonder why Judge Cannon did not assign the task to Reinhart or one of the other 15 magistrate judges that sit in the Southern Florida District rather than assigning an outside attorney (who would need a high-security clearance to carry out the special master responsibilities in a case that involves seizures of highly classified material).
In a dignified manner, Trump said Reinhart is prejudiced against him (because he recused himself from another litigation involving Trump). Because it considers the privilege-review procedure it unilaterally devised with Reinhart’s approval to be adequate, the Justice Department did not suggest that the case be transferred to Reinhart or an other judge. Without any consideration of other potential possibilities, the disagreement now centers on whether or not a special master should indeed be appointed.
Executive privilege is the main point of contention in the case and what will probably prompt DOJ to file an appeal.
