In order to teach state and local officials how to use red flag legislation to seize guns from gun owners who pose a threat to themselves or others, President Joe Biden’s Department of Justice has established a new organization. Conservatives attacked the newly established center, which aims to strengthen red flag regulations to seize guns from those who pose a threat to gun owners.
On Saturday, the Department of Justice declared the establishment of the National Extreme Risk Resource Center. “The Center” will also be the name of the new organization.
“Law enforcement members, prosecutors, lawyers, judges, clinicians, community leaders, and behavioral health professionals will receive training and technical assistance from the National Extreme Risk Resource Center. This center is dedicated to implementing laws that aim to prevent potentially dangerous individuals from obtaining firearms.”
ERPO laws, often known as red flag laws, give the government the right to seize guns from lawful gun owners without following the proper procedures.
Law enforcement may search for and confiscate “dangerous persons'” guns under ERPO legislation. Red flag laws also provide judges with the authority to impose interim restrictions that forbid “dangerous” people from obtaining or owning guns.
21 states and the District of Columbia have passed ERPO legislation, according to the DOJ news release.
Using federal monies from the Bipartisan Safer Communities Act, which provides $750 million for “red flag programs, mental health courts, drug courts, and veteran treatment courts,” just six of the states have enacted ERPO statutes, according to the White House.
The U.S. Department of Justice, the Bureau of Justice Assistance, and the Johns Hopkins Center for Gun Violence Solutions have partnered to create the National Extreme Risk Protection Order Resource Center.
“The National Extreme Risk Protection Order Resource Center will provide our partners around the country with essential information to keep weapons out of the hands of those who represent harm to themselves or others,” said Attorney General Merrick B. Garland. The creation of the Center is the most recent illustration of the Justice Department’s efforts to prevent gun violence in communities by utilizing all of the resources made available by the historic Bipartisan Safer Communities Act.”
Benjamin C. Mizer, acting associate attorney general, continued, “It is more important than ever to support our law enforcement and community partners in eradicating the scourge of gun violence. This Center will give communities additional tools and technical support to help them adopt successful crisis intervention tactics and lower gun violence, in addition to existing resources used throughout the Justice Department.
The Center has drawn criticism from conservatives who see it as a fresh instance of government overreach that aims to violate Second Amendment rights and seize firearms without following the proper legal procedures.

Representative Marjorie Taylor Greene (R-Ga.): “Merrick Garland recently revealed that the DOJ would be conducting a huge Red Flag Operation to violate the Second Amendment of the United States by utilizing EVERY espionage instrument available to the US government! This immediately follows Johnson’s complete funding of Biden’s militarized DOJ.”
Columnist David Harsanyi: “Utilizing a unilateral government edict to defend ‘democracy’ by depriving Americans of their due process and Second Amendment rights.”
The timing of this is purposeful, according to Rep. Tim Burchett (R-Tenn.). This assault on our Second Amendment is unauthorised.”
Spike Cohen, a libertarian activist: “This is a Federal Red Flag.”
Dana Loesch, a gun rights activist, says, “This won’t apply to Hunter Biden, undocumented immigrants, or cartel members that Democrats try to arm.” This is a violation of due process and disobedience of the law, which allows for the determination of an ineligible person. Without the loss of due process, all past disasters were avoidable.”
I just read where the Democrats are telling the illegal invaders they can own guns, and now they want to tell the American citizens they can’t? This is unbelievable. I can’t believe there is one American that would condones that. What happens when all the illegals have guns and we don’t have?
