Joe Biden got some more bad news from the Supreme Court this week, after the Justices ruled that Biden’s insane OSHA vaccine mandate for large companies was unconstitutional. In a 6-3 unsigned decision, the court ruled that OSHA does not magically gain new powers that were not delegated to it by Congress just because there’s a pandemic.
In a nutshell, OSHA cannot force companies that have 100 or more employees to mandate COVID vaccines and/or testing for all their workers. This mandate was on shaky legal ground to begin with, so it’s not too much of a surprise that the court shot it down.
For example, why mandate the vaccines for companies with more than 100 employees? Does the virus not spread at companies that have 99 or fewer workers? Huh?!
Anyway, 80 million Americans were spared from an unlawful mandate to choose between keeping their jobs or taking an experimental medicine that they didn’t want. As for health care workers, the court threw them under the bus in a separate ruling. Because many hospitals take Medicare or Medicaid dollars, the court ruled that a vaccine mandate for healthcare employees is just fine. Sorry, nurses. You’re expendable.
